A quote from the David Symons's attorney, Philip Sturtz's in his closing arguments, January 29th, 2009, in Judge Fred Borchards court room at a few minutes after 5:00PM
Mr. Sturtz started his argument by saying "it's a sad state of affairs that we have to come here before this Court and ask for enforcement of the Court's order and to ask for contempt in this particular proceeding. I wish the parties would get along, kiss and make up and we'd go home, but I---that's not going to happen."
Damm right it's not going to happen you ass hat.
So off to the witness stand mother went, and the grilling began. Here is where Mr. Sturtz tries his best to be forceful and intimidating. He wasn't.
Next up was yours truly and the questions took on a different tone. He asked how could a photo be taken and posted on "The Red Door Journal" after we were to have been long gone from the cottage? Who snuck back up there to take that photo? I demand an answer.
Let me show you the photo and you decide if this was taken in December, January or August. Oh and lets not forget that his client had that door repainted several days after it was painted red, hint, August....
It was left to me to explain why these two damsel's are barefoot in December!
I guess you get what you pay for.
Last up was David, and he was able to enjoy the always charming and suave Mr. Street! I think the judges words were, "please back away from the witness"! That should tell you the nature of the questioning David faced. He did stumble several times regarding his motives in filing for contempt charges. When asked if he was doing this for the money he responded, "no". Explain why your motion asked for fines, and damages then? No audible response there.
The day ended with the judge recapping the days events and adds his thoughts on what should be done. He asks once again if the plaintiff still wants the defendant "to go to prison --or excuse me, to go to jail, are you asking for a fine then?"
Mr. Sturtz: Yes.
And in keeping with his swift and precise rulings, the judge indicated he will take this under advisement and have a ruling in three days!
On February 5, 2009 the defendant was found not guilty and each is responsible for their own costs. Typical.....
Awhile back I was admonished for making comments about this judge, however I believed my comments then were right, and they most certainly are now, this judge lacks testosterone, and he couldn't find his balls if he reached into his robe with both hands.

First of all, I view the hijinx of Skirtie and Slymie against your mother as a form of elder abuse. It's pure evil what those men did to this charming lady- in her golden twilight years.
The "motive" of the contempt charges was obvious- they were just trying to use it as leverage to seal the deal (the theft of your cottage)in the swiftest manner possible, and at the lowest out of pocket expense to douchey David, his old lady, and his hick in-laws.
Could you please post a photo of your Uncle Slymie from the witness stand? (or anywhere)

What's going on with Slymie up at the lake? Last we heard, he didn't have the balls to attend the Lakeside auction, despite being President.
We also heard that no Lakesiders had the balls to confront him, or ask him to step down at the Annual Meeting.

Lakeside has the president it deserves.
You all can bash Lakeside but if you have to live up there with this no good asshole you to wouldn't say much. Slymie is the worst person to live close to anyone. We don't say anything cause for one he never made a open forum meeting after the annual meeting so he basically saved his ass on that one. We are a loyal camp to everyone except him. We have been divided because of him and he likes that. He has his friends up there no matter what he did to his sister and his messed up kids are trying to be friends with everyone. False smiles etc. They all make me want to puke.

I'm not sure where all of the "lakeside bashing" is coming from. I don't see how Lakeside's image is lowered at all. David sucks... we know... it sucks that he's still the president... and it sucks that he dipped his own sister the way he did. That ALL sucks.
I don't see why people have been saying that this ordeal has ruined Lakeside. I also don't see why everyone is so distraught about how no one spoke up at the meeting. Big deal. Yeah, I would have loved it if someone would have done something differently there - but I can understand why nothing was said. Some people are just too afraid of altering their image there (hence all of the anonymous posts). And that's okay too. But none of us can change how the meeting went. So, lets move on.
As for someone resulting to "Lakeside has the president it deserves" -- that's a bit much for me, and I really would like to know why someone would feel that way. What did LAKESIDE do in order to deserve such a jerk?
And one last thing- Why are the existing members of Lakeside letting this divide their camp? This happened in OUR cottage, which was bad enough - why let it spread out and diminish any other relationships between cottages? I don't understand that.
Lakeside has the president it deserves because their karma has created that for them, and because they have forsaken all opportunities to recall said president. It's not a value judgement on Slymie, really, just that they have who they have and there is a divine reason for everything.
Has anyone received word yet on the 20K transfer fee due the Association from Slymie and the Radke Reinhart Trust?
