The what trust? We thought David was buying the cottage!!

From the very beginning, there were a few things that remained constant. One, expect the worst. Two.. David C. Symons wanted the cottage. Three... in Mr. Meyer's "rules" for sale.. purchaser could not assign their rights of purchase. Ok. David C. Symons had taken Carol off the deed sometime before all of this started. David C. Symons was the only person to submit a bid. In every piece of paperwork, David C. Symons was the person buying the cottage. In all the various motions to convey sale, it was to David C. Symons.

So, to our surprise, (again, expected response).. Mr. Meyer's letter dated Dec. 1 now has the cottage being purchased by David C. Symons as well as the Reinhart Radke Trust. What? I mean, we know the name... it was Carol's father. The letter from Mr. Meyer went on to explain what costs, special assessments, real estate transfer taxes etc. were to be paid by seller (us). Deed recording to be paid by buyer...etc.

He also went on to state: "It has been my experience that cottage properties are normally sold with most of the furnishings. However, before I complete my report to the Court with respect to the sale closing, I would like to hear from each of you with respect to your proposal for the furnishings and personal property.

Finally, Mr. Sturtz has requested that his client not be required to purchase his own interest, and additionally that the two-thirds interest which is held by the other tenants in common be acquired by a trust designated as follows:..."

and then, "Provided that Mr. Symons is willing to execute an assignment of his right to acquire the property under the Court's previous Order, I see no problem with this request. However, if the other parties have a concern with this proposal, I would be interested in your comments." blah, blah, blah...Very Truly Yours, David B. Meyer.

What???????? What happened to the "not assigning rights" part of the "rules" did we miss? What the hell was the Radke Trust doing getting into this mess in the first place????

It was just after the elections. Remember the market??? It hit bottom. Really bad. So, after scratching our heads for a bit, we could only surmise that David needed to find a buyer. Hmmmmm. And, hello? What about the multiple requests for lists of personal property etc. and inventories that had been requested??? Yeah. WHAT ABOUT THAT?? There is a lot of stuff up there. About 4 generations of stuff plus all the stuff that came over from the cabin. Yeah.. what about that???? David could go to hell before we would walk away from all of our STUFF. Just wait a few years when the radke's realize what a liar carol and slymie are. They'll end up in court just the same as you did. I can't believe after all this was happening that david tried to get you to pay his attorney fees. What another slap in the face. He has NO morals or anything for that matter. Did you notice that when they are up there someone else is there with him? It's like he's scared to be up there by himself. Stu wouldn't do it either cause he's another sissy boy.

Huh? That's strange. Who do you reckon Slymie will leave his share to when he croaks? Radkes? Na.

His own kids don't seem really into the lake at all. Didn't Rick buy a cottage somewhere else? He's just not that into it.

BULLSHIT! Per Mr. Meyer's own rules, no assignments of purchase rights were allowed. I trust you Lees objected vociferously to this unmitigated BS.

Piled higher and deeper! Look, that may be normal protocol when someone voluntarily sells a property-- but your interest in this property was forcibly hijacked from you! Why didn't your attorney push to have all costs related to this abomination absorbed by your Uncle Slymie?

Funny how ALL statements produced by Mr. Meyer were SLANTED in favor of David Slymons. Examples:

"It has been my experience that cottage properties are normally sold with most of the furnishings"

"Mr. Sturtz has requested that his client not be required to purchase his own interest"

commentary:(scratching my head!!-
If Mr. Sturtz's client could not purchase his own interest- after all this drama- then the court should have dismissed the matter entirely!)

Provided that he is "willing?" This is a slymeball move, in violation of Mr. Meyer's own rules, which clearly benefits Slymie greatly. But, Mr. Meyer, in all his infinite wisdom, makes it sound like Slymie would be doing the Court and the defendants a huge favor by assigning his right to purchase the property!

Well of course you didn't, Mr. Meyer! Your head was so far buried up Uncle Slymie's ass, you could've told the court what he had for breakfast each morning!

Yes, all proclamations from Mr. Meyer were for the sole benefit of plaintiff David C. Slymons.

Don't EVER go to court in Saginaw! The cronyism is rampant. Makes Detroit look good.

I am assuming the only good thing that came from putting the ownership into the Radke trust is that now Lakeside's general fund is flush with cash from the transfer fee that was paid.

Yeah, the recession took a huge chunk out of David's ass, by all accounts. The scuttlebutt around Saginaw is that Slymie's little shop is dead as a doornail. He was never that rich to begin with, and probably hadn't invested wisely. No wonder he needed to con the Radke's into subsidizing his quest, his "cause celeb" to steal your cottage.

Nice legacy to leave the kids.

Kids? what do they think of all this? Slymie must have lied his ass off to them and said it would be lost and forgotten years from now. I just can't believe he would do something this horrendous. Also can't believe his kids are trying to be nice to everyone when they showed up in court to support their scamming father. They are just as bad as the old man. Ban the bastard. I hope they can his ass at the annual meeting in front of the whole camp. That would be the last laugh. Or he'll sue Lakeside for lack of appreciation. He gets his kids to report on the condition of lakeside when the fat ass should be doing the dirty work himself. SCUMBAG!!!!!!!!
I have never heard of a prez doing that before. Come on board of lakeside make a decision on this fool

I have the utmost confidence in the board that they will do what they can, when they can. Their job is tough enough, lets not make it any harder.

Please keep things on a civil and pleasant tone, my guess is none of us would want to be in their shoes.

AGAIN, Lakeside board has NO power to remove any board member. It is the voting members at the Annual Meeting. Someone at the end of the meeting will have to ask for a vote instead of the usual motion to re-elect the board. It would involve a simple majority vote(silent paper vote). If the vote of confidence is less than 50% than that board member, they would be removed. That is true for any board member.

Some one on the board has to stand up to the bully Slymie.....and vote him off the island! He should not be allowed to represent Lakeside with all of his backdoor deals and letting the seclusion and enchantment of Lakeside become a circus to the public.....Mrs. Lee would have never done this sort of thing...she has too much class....her brother on the other hand has become public nuisance #1.

The board CAN'T vote him off. It's takes a motion FROM the floor during the annual meeting and then a silent ballot will reveal if each member on the board has more than 50%.If not they are gone. A simple ballot with ALL the names of the board members and you can put an X only next to the board members you wish to keep. Then add them up. I really don't think that David can get 50%...he would be voted off and the next in line becomes the prez and then another board member needs to be selected soon. Let's hope we have testicles to do this fellow campers.I am a yearling in my family so I can't do it.

Maybe the hatred is setting in and they know it finally. Just sell out slymie cause everybody HATES you up here.
