SYMON SAYS...pt.2

So, we argued back and forth...no surprise there. David assigned the purchase rights to the Radke Trust. With that, they wanted us to pay the fees related to the transfer of deed..that would be "no". So then came the issue of property. We'd been asked to submit lists many months prior to this and both mother and David had done so. You should have seen David's. Right. Nice list. He actually had a question mark next to the porch swing. (I built it 28 years ago). He would not be getting that!!

In a letter dated Dec. 9, 2008 to Mr. Meyer, Mr. Sturtz says.."As to the personal property and the requests of the sister, David Symons has no objection to her taking those items. Katy has requested a picture of her mother and father on skis, plus a barometer, and Mr. Symons has no objection to her taking the picture of the mother and a copy of the picture of father on skis.

Mr. Symons has no objection to the Lees taking the items which they indicate are theirs and Katy taking what she claims is hers. Those total some eleven items specifically mentioned. All other items are to stay with the cottage and if there is no agreement as to the disposition of the other items they are to be packaged up by a moving company and placed in storage pending auction".

Yeah right!!! Over our dead bodies. Of the items that we had listed as ours as well as some of the items we'd requested, he says...

"The primary items over which some individuals have some interest are:

1. OLD china in the front and back cottage;
2. Picture of Indian Chief:
3. A paddle made by an Indian Chief (hanging on the wall of front cottage) and;
4. An old rug, which apparently was appraised at approximately $6,000.00

Of those items Mr. Symons is suggesting that the Indian picture and paddle remain with himself, along with the couch in the back cottage. The china goes to sister Joe, along with the rocking chair, books, copy of the picture of Ben Symons on skis, round table and chairs in back cottage, Ben's fly rod and wish's picture.

Katie is to get her barometer, a copy of the picture of Ben Symons on skis and Stu may have the rug".

What??????? And who does he think he is??? Notice the spelling of names...earlier he had them right, later it was sister Joe and Katie. Phil never once got the names right. He mangled every one of them. So, there was clearly going to be a big ole fight over the stuff. Lot's of stuff. Plans for scheduling a meeting were to come. Knowing that we were going up for Christmas, they were playing with some dates between Christmas and New Year's. Yeah. That wasn't going to work out so good. Also, on David's request for injunction... the judge didn't get around to ruling on that one when he said he would. Usually, the motions were "taken under advisement". I'm sure there are many that were never ruled on. We'll see.....

Didn't you protest that this violated the court's own 'no assignment' rule?

Uncle Slymie didn't protest Katy taking a picture of her parents? Isn't that kind of him. Maybe his heart hasn't turned to stone after all.

Why? He would have been a disgrace to Indian culture, which cherishes family relationships and reveres Elders. Slymie would have been condemned by the Indians in the strongest possible terms, particularly the Wanigas tribe.

Can't imagine Stu would want the rug, unless Kathy got wind of it's value. Now I ain't sayin' she's a gold digger, but...

Couldn't you have instigated some sort of ethics investigation? I mean really, this whole thing was untoward. The Judge and Meyer's co-owning a boat together? WTF? It's unseemly.

We argued every lie..every underhanded attempt and challenged the ethics. This folks, is what happens. Our attorney was a gentleman. Smarter than Phil, but for some reason, ethics, smarts, etc. did not work. Stay away from this type of action.

The smartest lawyers in the world cannot combat cronyism and corruption on the bench.

I knew for certain something strange was going on after I was lucky enough to be in town for the court ordeal in January. (I am sure you will get to that as soon as it falls into the line of events)
I missed the last half of the day, which was the most exciting portion. And as it may have seemed that there was a whole lot of nothing going on in the courtroom in the morning, there was really a lot of interesting body language. Although everyone else was pretty friendly, making small talk with us, smiling, being cordial...
David sat on his bench on the opposite side of the courtroom from us and kept his back turned to us at all times. It appeared quite uncomfortable to force himself that way, I might add. The occasional slow look over his shoulder to catch my eye contact or someone elses from our direction resulted in a quick whip of his head and eyes back to his side. Funny, but not surprising.

What I thought was especially interesting, and the reason why I wrote this lengthy comment, was that I noticed that there was a man that walked rather quickly through the courtroom to the front during the time court was assembling. He smiled at David's side and said "hello, how are you" to David who turned to say "hello" to him and smile in return. Since this man never addressed our side of the courtroom, and seemed to avoid us altogether, I assumed he was some person working with their legal counsel.
I really to this day believe my first assumption based upon body language was correct.
When I asked who this man was, it made sense...
That man was the mediator.

I'm telling you,
a picture is worth a thousand words (or more)
and body language speaks volumes.

That's very interesting, Carlie. Body language does say it all.

I knew there was some hanky panky going on between Slymie and Meyers.

Meyers was by NO MEANS an un-biased, objective mediator. He was doing Slymie's bidding the WHOLE TIME!

What a crock of shit this whole ordeal was. So sorry your family had to go through it.

David's probably hosting his buddies, wink wink nudge nudge --Meyers and da Judge as we speak for docktails at his posh South Higgins Lake condo.

Maybe he's even taking them out for a ride on that putrid monstrosity of an old boat.
